Hi,
I know the rules changed in October 2008, but I don't know what to - I can't believe they changed hugely dramatically from a mum's point of view.
From what I understand (and I'm not legal person), you're entitled to 12 months maternity leave, 6 of which should be on full pay. Maternity leave starts from when you leave work - not when you have the baby, so let's say you left in June, 12 months obviously takes you to June 2009.
I think the problem here is around you returning in February ... rather than extending your leave to June, so the wonderful processes your company follows probably assume you've been ill for 7 months and not for 3. I would consider trying to argue that you could have taken 12 months maternity and asking them to consider putting you on 12 months retrospectively (which would mean you've been off sick for 3 months). I have no idea what that would mean money-wise though, other than complicated and bad.
Also, depending on what your job is, if you're on medication, are not drowsy and are essentially fine, then there's no reason I can see why you shouldn't be allowed to work if you want to. Be aware though that no one in the tribunal will ever have heard of the condition, despite it being relatively common.
In answer to your earlier question ... sadly I don't believe there are any particular underlying causes - it's just random and bad luck to whoever it hits.
I know your meeting's on Monday, but have you considered any representation? If you can get some, they may be able to explore other avenues?
Hope it goes well,
D.
